Press Release issued by Hughes Fields and Stoby
Refence is made to a Guyana Police Force Press Release dated the 11th July 2025 in which the Guyana Police Force contended “The GPF has noted with concern the recent press articles alleging that the prosecutor was ill-prepared to present their case.”
Members of the firm of Hughes Fields and Stoby were issued with a fiat by the Director of Public Prosecutions to prosecute the charge of murder against Marlon Da Silva.
The sole institution responsible for the investigation of the murder and the provision of the evidence gather during the investigation to the Prosecutors, is the Guyana Police Force.
The presentation of this case at trial depends primarily on the Police witnesses and the conduct of the investigation by the Guyana Police Force.
Magistrate Judy Latchman who has conduct of the case had ordered that all the evidence which the prosecution intends to rely on must be provided to the court and the defence by the 12th May 2025. This Magistrate’s directions were communicated to the DPP on the 30th April 2025 by way of letter from Hughes Fields and Stoby.
After the directions of Magistrate Latchman, the Guyana Police Force still had not provided Hughes Fields and Stoby with all of the evidence and sought to provide additional statements as late as the 26th June 2025, a date long after the date on which statements were ordered to be provided by the Magistrate.
On the 10th July 2025 when the matter was called before Magistrate Latchman, counsel for the prosecution was present and represented the DPP.
The Court made inquiries about the status of Ms Latchmie Rahamat as a defence counsel as she had received information that she had withdrawn from the conduct of the case.
The court did not commence the hearing of the matter and no application was made by Mr. Datadin or any other Counsel for the Accused to have the matter dismissed.
On every occasion when the matter has been called Hughes Fields and Stoby has been ready and able to proceed with the prosecution of the matter.
The success of the prosecution of this matter is dependent on whether the Police witnesses attend court and testify.
Hughes Fields and Stoby denies without reservation that they have been unprepared and or ill prepared for the conduct of the trial. It is the Guyana Police Force which has failed to provide statements and evidence to the Prosecutors in a timely matter in keeping with the Court’s directions.
Hughes Fields and Stoby welcomes a full investigation of any complaint by the Guyana Police Force in relation to the conduct of the Prosecution of this charge against Marlon Da Silva.
