See full statement from the Guyana Geology and Mines Commission:
The Guyana Geology and Mines Commission (GGMC) reminds all stakeholders that mining lands are granted to individuals and entities for the purpose of undertaking mining activities, subject to the applicable laws, regulations, and conditions governing the relevant mining tenure. As such, tenure holders are strongly advised against selling or purporting to sell mining lands, as these actions may contravene the legal and regulatory framework governing the mining sector.
The Commission also discourages the use of Irrevocable Powers of Attorney in transactions involving mining lands. An Irrevocable Power of Attorney is not, in itself, acceptable proof of ownership or lawful tenure. Persons are urged to exercise caution and to verify the legal status of any mining property directly with the GGMC before entering into agreements or making any financial commitments.
The GGMC remains cognizant that some mining properties may require additional investment, technical expertise, or financial resources for development, and as such, encourages miners and tenure holders to explore lawful Joint Venture arrangements with suitable partners. Such arrangements can facilitate the productive development and beneficial occupation of mining properties while remaining compliant with applicable legal requirements.
In addition, the GGMC wishes to remind all operators and stakeholders that strict adherence to mining laws and regulations remains a priority. Compliance and enforcement exercises will continue across all Mining Districts as part of the Commission’s mandate to ensure orderly and lawful mining activities throughout Guyana.
Persons found to be in breach of the mining legislation will be subject to enforcement action, including prosecution where warranted. In cases involving non-nationals, deportation proceedings will be pursued where applicable under the laws of Guyana.
The Commission also reminds miners of their legal obligation to sell all gold produced to the Guyana Gold Board (GGB), licensed Gold Traders or Dealers. Compliance with this requirement is compulsory and essential to maintaining transparency, accountability, and integrity within the mining industry.
The Ministry of Natural Resources and the GGMC remains committed to safeguarding Guyana’s mineral resources, promoting responsible mining practices, and ensuring that all mining activities are conducted within the framework of the law.
