Chief Justice (acting) Roxane George has thrown out the recent legal challenge against the appointment of Clifton Hicken as Commissioner of Police.
She made the ruling today in the High Court. This challenge was filed by Troy Garraway, who was represented by attorney Dexter Todd.
The applicant had questioned the legality of Hicken’s substantive appointment after he reached the retirement age for public servants in 2023, which is 55.
In her decision, the Chief Justice found that there are no legal provisions in the Constitution or the Constitution (Prescribed Matters) Act that prohibit the appointment of a Police Commissioner beyond the age of 55.
The Chief Justice awarded costs amounting to $500,000: $200,000 to the State and $300,000 to Hicken.
Hicken was in March 2022 appointed by President Dr Irfaan Ali as acting Police Commissioner.
In December 2024, Hicken was substantively appointed in the position.
There were previous legal challenges mounted by opposition members throughout various stages of Hicken’s appointment as Top Cop but they were all dismissed by the courts.
