The blasphemous libel charge that was filed against social media personality, Daniel Wharton, also known as “Baby Skello,” was dismissed on Friday after Magistrate Wanda Fortune ruled that it was flawed and legally unsound.
Wharton was charged in June 2025 and initially remanded to prison over a song he performed on TikTok that referenced the Hindu Goddess Mother Lakshmi. He later secured High Court bail following an application by his attorneys, Everton Singh-Lammy, Angel Stephens, and Glen Hannoman.
The charge sparked widespread debate and criticism, particularly within sections of the Hindu community. The young singer was later brought in by the Ethnic Relations Commission and subsequently offered a public apology.
On Friday, Magistrate Fortune dismissed the charge after determining that the law used to bring the case did not apply to the circumstances. She further explained that the legislation under which Wharton had been charged specifically relates to offences against the Christian religion.
As a result, the court found that the law could not be applied to an incident involving references to a Hindu deity, making the charge defective and unsustainable in law.
