[www.inewsguyana.com] – An 18 – year – old was ordered to pay a fine of $5000 by Magistrate Alex Moore after he appeared before him in Court 10 of the Georgetown Magistrates’ Court, charged with indecent exposure in public.
Devendra Sukhai, a resident of the West Coast Demerara (WCD), accepted the charge which read that on November 21, 2015 at the fire station compound, Stabroek, in a public place he indecently exposed his genitals.
He told the Court that on the day in question he was imbibing in alcohol in the vicinity of the fire station when the need to urinate arose. He stated that he was under the influence and his inhibitions were lowered, leading him to relieving himself on the fence nearby to the fire station.
He related that he was the approached by a female City Constable who told him of the offence and took him into custody.
The Magistrate stated that upon reviewing that charge, he came to the conclusion that the young man was slapped with the wrong charge. The charge that he was appearing for falls under the Sexual Offences Act, but he did not expose himself in a sexually mischievous way.
As such, he should have been charged with urinating in public. The Magistrate reprimanded the defendant and sentenced him to pay a fine of $5000.
